1. Agreement to Terms

By accessing or using The Sober Legion (the "Platform"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Platform.

2. Medical Disclaimer

The Sober Legion is a peer support community and is NOT a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or recovery plan. Never disregard professional medical advice or delay in seeking it because of something you have read on this Platform. If you think you may have a medical emergency, call your doctor or 911 immediately.

3. Age Requirement

The Platform is intended solely for adults aged 21 and older. You must be 21 years of age or older to create an account or use the Platform. At registration you are required to provide your date of birth and to affirmatively confirm that you meet this age requirement; by doing so you represent and warrant that the information you provide is truthful and accurate. We do not knowingly permit anyone under 21 to use the Platform. If we learn that a user is under 21 β€” including through a misrepresentation at sign-up β€” we will suspend and close that account and delete the associated data. If you believe someone under 21 is using the Platform, please contact us at sobersoldiersoutreach@gmail.com.

4. User Accounts and Content

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password.

Our Platform allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Platform, including its legality, reliability, and appropriateness. The Sober Legion takes no responsibility and assumes no liability for any Content posted by you or any third party.

5. Termination and Moderation

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms or our Community Guidelines. Upon termination, your right to use the Platform will immediately cease.

6. Limitation of Liability

In no event shall The Sober Legion, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use or alteration of your transmissions or content.

7. AI and Automated Bots

The Platform utilizes artificial intelligence and automated bots (e.g., "LAI") to facilitate engagement. These bots generate automated responses and content. You acknowledge that AI-generated content may be unpredictable, inaccurate, or offensive, and The Sober Legion assumes no liability for statements made by automated bots. Do not rely on AI for medical, legal, or professional advice.

8. Paid Memberships & Virtual Currency

The Platform offers one optional paid feature: Legion Membership ($5/month via GiveButter), which grants a verified badge and extended post limits for the duration of your active subscription. "Legion Stars" are a virtual currency that cannot be purchased β€” they are earned only through daily check-ins, sober milestones, and gifts from other members, and are used within the Platform to send gifts, boost posts, and redeem profile badges, effects, and frames. Stars have no monetary value, cannot be bought, sold, or exchanged for cash, and may be adjusted or reset where necessary to protect the integrity of the community.

We reserve the right to modify pricing, features, or availability of any paid feature at any time. If you have an active paid membership, changes to pricing will take effect at your next renewal cycle. You may cancel your membership at any time through your account or payment provider. Donations to Sober Soldiers Outreach are not tax-deductible, as we are not a tax-exempt organization.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States of America, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Platform shall first be addressed through good-faith negotiation. If unresolved within 60 days, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association in Denver, Colorado. You and The Sober Legion waive any right to participate in a class action lawsuit or class-wide arbitration.

11. DMCA / Copyright Takedown

We respect intellectual property rights. If you believe content on the Platform infringes your copyright, you may submit a takedown request under the Digital Millennium Copyright Act (DMCA) to our designated copyright agent at sobersoldiersoutreach@gmail.com with the subject line "DMCA Takedown Request." Include: (a) identification of the copyrighted work, (b) the infringing material's location on the Platform, (c) your contact information, (d) a good-faith statement that the use is unauthorized, and (e) a statement under penalty of perjury that you are authorized to act on the copyright owner's behalf. We will process valid requests promptly.

12. Third-Party Services

The Platform integrates with third-party services including a payment processor (GiveButter), email services (Gmail), and AI language model providers. These services have their own privacy policies and terms. We are not responsible for the practices of third-party services. When you interact with content or features powered by AI, your input may be processed by third-party AI providers to generate responses.

13. License to Your Content

You retain all ownership rights in the Content you create. By posting Content to the Platform, you grant The Sober Legion a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt (for formatting and display), and distribute that Content solely for the purpose of operating, promoting, and improving the Platform β€” including allowing other members to view, comment on, repost, and share it within the Platform. This license ends when you delete the Content or your account, except that (a) Content other members have reposted or quoted may remain visible, and (b) backup copies may persist for a limited period. You represent that you own or have the necessary rights to the Content you post and that it does not infringe anyone else's rights.

14. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted, secure, or error-free, that AI-generated content will be accurate, or that any content, resource, or support offered by members or automated features will meet your needs or produce any particular outcome. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless The Sober Legion and Sober Soldiers Outreach, and their directors, officers, volunteers, employees, and agents, from any claims, damages, losses, liabilities, and reasonable legal fees arising out of (i) Content you post, (ii) your use of the Platform, (iii) your violation of these Terms or our Community Guidelines, or (iv) your violation of any law or the rights of a third party. We reserve the right to control the defense of any such claim, and you agree to cooperate with us in that defense.

16. Counter-Notification & Repeat Infringers

If your Content was removed following a DMCA notice and you believe the removal was a mistake or misidentification, you may send a counter-notification to our copyright agent at the address in Section 11. It must include: (a) your physical or electronic signature, (b) identification of the removed material and where it appeared, (c) a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification, (d) your name, address, and telephone number, and (e) your consent to the jurisdiction of the federal court for your district (or, if outside the United States, any district in which we may be found) and your agreement to accept service of process from the person who filed the original notice. We may restore the material as permitted by law. We also maintain a repeat-infringer policy: accounts that are the subject of repeated valid infringement notices will be suspended or terminated.

17. General Provisions

Severability β€” if any provision of these Terms is held unenforceable, the remaining provisions stay in full force. No waiver β€” our failure to enforce a provision is not a waiver of it. Assignment β€” you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or transfer of the Platform. Entire agreement β€” these Terms, together with our Privacy Policy, Consumer Health Data Privacy Notice, and Community Guidelines, constitute the entire agreement between you and us regarding the Platform. Force majeure β€” we are not liable for delays or failures caused by events beyond our reasonable control. Survival β€” sections addressing content licenses, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination of your account.

18. Mobile App, Permissions & Account Deletion

The Platform is also distributed as a mobile application. Your use of the app is additionally subject to the rules of the app store you obtained it from, and those stores are not parties to these Terms and have no obligation to provide support for the app. The app requests device permissions only for the features that need them β€” microphone (voice chat and voice messages), camera and photo access (attaching images), and notifications β€” and each is optional and can be declined or revoked in your device settings.

Account deletion β€” you may permanently delete your account and associated data at any time from the Settings screen inside the app, or by emailing sobersoldiersoutreach@gmail.com. User content and safety β€” the Platform contains user-generated content. We provide in-app tools to report posts, profiles, and messages and to block other members, and we review reports and remove content that violates our Community Guidelines. Objectionable content, harassment, glorification of substance use, and solicitation of illegal activity are prohibited.
